Court Martial opens fresh Charges against Kayihura’ blue eyed boy Nickson

The Makindye General Court Martial on Monday read out fresh charges to SSP Nixon Agasirwe, 47, relating to Kidnap, contrary to section 239 Cap 20  of the Penal code Act.

Agasirwe, who is already facing two counts counts of Kidnap alongside 8 others before the same court, was today charged with a third count alongside one Semujju Abdulnur alias Minana.

The 9 suspects who include 5 senior police officers were in October charged for kidnapping two Rwandan nationals Joel Mutabazi and Jackson Kalemera.

Minana, who is said to have been a police informant working under Agasirwe, was not part of the initial nine suspects.

Prosecution alleges that on 13th August 2013 at Bukooli village, Nyimba sub county Bombo in Luweero district, while armed with fire arms and grenades — a monopoly of the UPDF – the duo compelled Vincent Kalisa, without his consent to return to Rwanda

The fresh charges sparked a heated argument between the court chairman Lt. Gen Andrew Gutti and Defence counsel Frank Kanduho who sternly objected to the charge sheet as “defective.”

Kanduho says the charge sheet lacked details of the person who is alleged to have been kidnapped and that pleading to it would be unlawful.

On the advice of the Judge Advocate of the Court Lt Col Gideon Katinda, Gen Gutti asked the prosecution to amend the charge sheet the next time the case returns.

The accused Nixon Agasirwe denied the accusation of kidnapping Kariisa, while his co-accused Minana refused to take a plea until he received guidance from his lawyer.

Currently, Agasirwe has a pending bail application hearing before this court.
